Registering a power of attorney for a Punjab property from abroad

A guide from our NRI Desk in Bathinda: what a special power of attorney covers, how consulate attestation and apostille differ, who can hold it, and why a GPA sale transfers no title.

What is a power of attorney, and why do NRIs buying in Punjab need one?

A power of attorney is a written authority in which you appoint a named person in India to act for you in a specific property matter. NRIs buying in Punjab use one so that somebody can sign the sale deed and appear before the sub-registrar without the buyer flying back to Bathinda.

Here is the correction worth making early. You do not have to fly in, but somebody does. Punjab has no fully remote property registry at present. A person holding your power of attorney stands at the counter, signs the register and is photographed.

Our NRI Desk in Bathinda handles this step for buyers in Canada, the UK, Australia and the Gulf. What follows is what happens at the counter, and what your paperwork abroad has to look like before it gets there.

Should you register a special power of attorney or a general one?

Register a special power of attorney. It names one property, one transaction and one list of permitted acts, so the holder can finish that registry and nothing else. A general power of attorney is revocable in the same way, so the difference is not how hard it is to cancel. The difference is scope: a GPA hands broad authority over your affairs in India, and once it has been shown to banks, developers and offices you have to chase the cancellation everywhere it has travelled. The narrow document is the safer one.

A lawyer drafts it against the exact property you are buying. We do not publish a template, because a document that reads well in Toronto and fails at the Mansa sub-registrar has cost you a trip.

  • The property described as the revenue record and the developer describe it: colony, plot or unit number, area in sq yd, khasra or khewat number.
  • The permitted acts listed one by one: sign the sale deed, present it for registration, admit execution, take possession, apply for mutation.
  • The excluded acts in plain words: no sale, no mortgage, no lease, no transfer to the attorney or the attorney's own family.
  • A validity period, so the authority lapses on its own if the purchase does not go through.

Is a sale on general power of attorney a valid transfer of title?

No. In Suraj Lamp and Industries versus State of Haryana, decided in October 2011, the Supreme Court held that a sale done through a general power of attorney, an agreement to sell and a will does not transfer ownership. Title to immovable property in India passes only by a registered sale deed.

A genuine power of attorney used to execute a proper sale deed stays valid. What the Court rejected was treating the GPA itself as the transfer. This matters in older colonies around Bathinda and Mansa where a resale plot is offered on GPA below the surrounding rate. If the seller cannot show a registered sale deed in his own name, take an advocate's opinion before paying anything.

Consulate attestation or apostille: which one does a Punjab sub-registrar accept?

Both routes are used. Section 33 of the Registration Act, 1908 names Indian consuls and vice-consuls as well as notaries public among the people who may authenticate a power of attorney executed by a principal who does not reside in India, so a deed signed at the Indian consulate in Toronto and one notarised in Vancouver and apostilled can each be valid.

The consular route draws fewer questions at a Punjab counter, because the seal and the officer are Indian. The Apostille Convention came into force for Canada on 11 January 2024, so Canadian buyers now have both options; the UK and Australia have been parties for far longer, and the Gulf states differ, so check what the designated authority in your country actually issues.

Whether the power of attorney must also be registered in India, or only stamped and authenticated, depends on what it authorises and on local practice, and individual sub-registrars take different views. Settle that with an advocate before you sign anything abroad.

  • Sign before the consular officer at the Indian mission covering your city, or before a local notary on the apostille route.
  • Courier the original paper to India. A scan, a photograph and an emailed PDF are all useless at the registry counter.
  • Get it stamped in India within three months of its first arrival in the country, which is what Section 18 of the Indian Stamp Act, 1899 provides. Punjab sets its own stamp duty on a power of attorney and the notified rates change, so ask your advocate for the current amount rather than budgeting from an old figure.
  • Work with the sub-registrar office for the tehsil where the property lies, in its district: Bathinda, Mansa, Patiala, or SAS Nagar for Kharar, Mohali, Banur and Dera Bassi.

Who can validly hold your power of attorney in Punjab?

Appoint an adult you would trust with the money itself, usually a parent, brother, sister or spouse living in Punjab. The practical test is simple: the attorney's own identity documents are checked at the registry, so the person you name has to be physically available in the tehsil on the appointment day.

Punjab Roots Realty never receives buyer funds. Payments go directly to the developer or seller account through normal banking channels. Most families name a relative, and if nobody in Punjab is suitable an advocate can be appointed instead; our team can be named for the registry step alone where you prefer that. Whoever holds it, we book the appointment, attend the sub-registrar office with your attorney and courier the registered papers to you.

What does the sub-registrar in Punjab expect on the day?

Your attorney attends in person at the sub-registrar office for the tehsil where the property lies, carrying the original stamped power of attorney, the e-stamped sale deed and two witnesses. Photographs and thumb impressions are taken at the counter. Somebody has to be present in person; a Punjab registry does not complete with nobody at the counter.

Stamp duty and the registration fee are payable at the rates the Punjab government notifies, and those rates change, so confirm the current figure with your advocate or at the sub-registrar office. Mutation, the intkal entry in the revenue record, follows registration and is the step people forget.

  • Original power of attorney plus photocopies, your passport copy and passport photographs.
  • PAN card for you, identity proof for the attorney and for both witnesses; counters usually ask for the attorney's PAN as well.
  • The developer's allotment letter or buyer agreement, plus the sanction from the authority that applies, PUDA in the Bathinda, Mansa and Patiala belt or GMADA around Kharar, Mohali, Banur and Dera Bassi, and the PBRERA registration number where the project carries one.
  • Proof that the money moved through banking channels: an inward remittance, or a debit from your NRE, NRO or FCNR(B) account. Foreign currency notes and traveller's cheques are not a permitted route for a property payment.

How long does it take, and where does it fit in a Punjab purchase?

Allow four to eight weeks from the first call to a registered sale deed. Consular appointment dates and courier time drive that schedule far more than anything happening in India. The paperwork abroad is the slow part, and it is the part you can start before you have chosen the project.

The numbers place it. Plots at Motiaz Estate on the Bathinda-Muktsar Road, just off NH-7, are quoted from around Rs 25,000 per sq yd in sizes of 191 to 500 sq yd, which buyers here still count as gaj, roughly 6 to 16.5 marla. At that quoted rate a 200 gaj plot works out near Rs 50 lakh before stamp duty and registration. PUDA-approved plots at Arcadiaa Enclave on the Mansa-Barnala Road start from about Rs 55 lakh. Prices are as listed at the time of writing and change, so confirm the current rate with us. One special power of attorney covers one of these, not all of them.

NRIs and OCI card holders may buy residential and commercial property in India, but not agricultural land, plantation property or a farmhouse. If a parcel is classified as agricultural in the revenue record, we say so before you spend money on a POA. This page is general guidance, not legal or tax advice. Rules under FEMA and Indian tax law change, so please verify with a qualified professional before you transact.

Common questions

Can I email a scanned power of attorney to my brother in Bathinda?

No. The sub-registrar needs the original paper carrying the consular or apostille seal and the Indian stamping. A scan, a photograph or a PDF is not accepted at the counter. Courier the original and allow time for stamping in India before the appointment date.

How long does a power of attorney stay valid?

For as long as the document says. A special power of attorney drafted for one purchase should carry an end date, commonly six to twelve months, so the authority lapses on its own if the deal falls through. It also ends on revocation, and generally on the death of the principal. Narrow exceptions apply where an authority is coupled with an interest, so have your advocate confirm the wording.

Can I cancel a power of attorney after it is registered?

Yes. Revocation is done in writing, registered in the same manner as the original, and notified to the attorney, the developer and the sub-registrar office. Do it promptly if the purchase is dropped, and take an advocate's help so the cancellation sits on record.

Do I need a separate power of attorney for each project?

Yes, if you use special powers of attorney, which is what we recommend. One document names one property. Buying a plot in Mansa and a showroom in Bathinda means two documents, two attestations and two stampings, so plan for that before booking a consular appointment.

Does a power of attorney let my attorney sell the property later?

Only if the document says so, and a purchase POA should say the opposite. Ask the lawyer to write in that the holder cannot sell, mortgage, lease or transfer the property to himself or his family. Anything not written into the document is not permitted.
