Questions NRIs ask us most
Can an NRI or OCI card holder buy property in Punjab?
Yes. NRIs and OCI card holders can buy residential and commercial property in India under the general permission in FEMA and the rules notified under it, with no separate RBI approval needed. Agricultural land, farmhouses and plantation property sit outside that permission, though such property can still come to you by inheritance. Punjab Roots Realty tells you the revenue classification of a parcel before you commit, and you should confirm your own eligibility with a lawyer or chartered accountant.
Do I have to travel to India to complete the registry?
In most cases, no. A power of attorney executed before an Indian consulate or High Commission in your country, then stamped in India within the period the Stamp Act prescribes, lets the person you name attend the sub-registrar and complete the registry for you. The POA has to spell out the purchase and registration powers, and a sub-registrar, bank or developer can still ask for a particular form of it. Punjab Roots Realty guides you through the wording and the attestation steps, but have the draft checked by a lawyer, because a badly worded POA can be refused at the registry.
How do I pay for a property in Punjab from abroad?
Payment is made in Indian rupees from your NRE, NRO or FCNR(B) account, or by inward remittance through normal banking channels, and it goes straight to the developer's or seller's account. FEMA does not allow payment for property in foreign currency notes or by traveller's cheque. Punjab Roots Realty never receives buyer funds. Keep every bank advice and remittance certificate, because your chartered accountant will need them if you repatriate later.
If I sell later, can I send the money back to Canada or the UK?
Yes, in most cases, though FEMA sets conditions and the tax has to be settled first. Where the purchase was funded by inward remittance or from an NRE or FCNR(B) account, sale proceeds can be repatriated up to the amount you originally paid in foreign exchange, and for residential property that route is limited to two such properties. Anything beyond that, including the gain, goes through the NRO route within the annual remittance limit, which stands at USD 1 million per financial year, and needs Forms 15CA and 15CB. Limits and conditions change, so confirm the current position with your chartered accountant before you sell.
What tax is deducted when an NRI sells property in India?
The buyer deducts TDS under section 195 of the Income Tax Act, on the full sale consideration and not only on the gain. The rate follows the seller's capital gains position and carries surcharge and cess, and the buyer needs a TAN to deposit it. The seller can apply to the assessing officer under section 197 for a lower or nil deduction certificate, which is worth doing when the actual gain is small. Rates and conditions change with each Finance Act, so confirm with a chartered accountant before you sign.
How do I know the deal is genuine when I am sitting abroad?
By checking the things that do not depend on our word. Punjab Roots Realty works from a walk-in office at SCO 26, 2nd Floor, Ganpati Enclave, Bathinda, near AIIMS, so family in Punjab can visit. Every project carries its satellite boundary on Jameen Deal, the RERA or PUDA approval number is shown where the project has one, and on developer inventory the price is the developer's own rate with no brokerage markup, with payment going straight to the developer's account. Ask for a recorded walkthrough before you commit.
Can you look after the plot or flat after I buy it?
Yes, within limits. For plots, Punjab Roots Realty arranges periodic photographs and boundary checks against the satellite map on Jameen Deal, so you can see the current state of the parcel. For apartments and showrooms, the team introduces you to rental management partners in Bathinda and the Tricity. This is a coordination service, not a guaranteed rental or a caretaking contract, so agree the scope and the cost in writing.
What documents do I need to keep ready as an NRI buyer?
Keep your passport, OCI card if you hold one, PAN card, overseas address proof, passport-size photographs and your NRE or NRO account details ready. PIO cards were merged into the OCI scheme, so an old PIO card is treated as an OCI card. PAN matters most, because the sale deed and the tax deduction both refer to it. If someone will sign for you, add the consularised power of attorney and the attorney holder's Aadhaar and PAN. Punjab Roots Realty sends a checklist for the project you choose.
